The tax treaty

In force

The United States and Germany have an income tax treaty in force. It can lower the US tax withheld on dividends, interest and royalties paid to you, if you claim it on a W-8BEN with your German tax number, and it settles which country taxes what when both could. The treaty rate on royalties is 0%.

Stripe

Available locally

Stripe takes businesses registered in Germany, so you don't need a US company to use it. A US LLC gets you a US Stripe account instead, paid out in dollars to a US bank, which helps when most of your customers are American.

Banking

Mercury available

Mercury opens accounts remotely for US companies whose founders live in Germany. It asks for the EIN, the formation documents, your passport, a real business address and a description of the company's existing or planned US operations. Relay asks a non-US owner for a US address, an ITIN or Social Security Number and a US operating presence, so it rarely suits a founder living in Germany.

02What Germany expects

Owning a US company doesn't take you out of Germany's tax system.

Germany taxes its residents on income from anywhere in the world. Whether the LLC's profit counts as yours as it's earned, or only when you take it out, depends on how Germany treats a US LLC, and that's a question for a local tax adviser.

  • Germany decides how to treat a foreign entity by comparing it with German legal forms, and a US LLC is often treated as a corporation. A company whose place of management is in Germany is German-resident for corporate and trade tax, wherever it was formed.
  • Many European countries have controlled foreign company rules that can tax a resident on a low-taxed foreign company's passive income, such as interest or royalties. Some apply them only when another company is the owner, so ask a local adviser whether they reach you.
  • The US-Germany treaty is in force and settles which country taxes what. Royalties are taxed at 0% under it.

The filing is the same wherever you live. What changes is the tax treaty, the payment processors and the banks, which this page covers.
