02The straight answer

Should a founder abroad form in New Mexico?

New Mexico is the one state that really competes with Wyoming for a founder abroad. It's $50 to form, there's no annual report or yearly fee at all, and the owners' names never have to go on a public filing. What Wyoming has that New Mexico doesn't is a long record as the home of companies owned from abroad, which is what a bank's compliance team looks for. If your bank and payment processor are already sorted, New Mexico is a reasonable choice. We don't file there because we'd rather know two states thoroughly than three less well.

Both keep members and managers off the public record. New Mexico has no annual report at all, while Wyoming's costs $60 a year. Wyoming is much better known to banks and payment processors as a home for companies owned from abroad, and that usually matters more than the $60.

Yes. New Mexico, like every state, doesn't require an LLC's owners to be US citizens or residents. It does require a registered agent with a street address in New Mexico. New Mexico LLCs file no annual report and pay no annual fee.

No. We file in Wyoming and Delaware only. For a founder outside the US, they're the two states worth being in, and we'd rather know two states well than fifty a little. If your business will have staff, an office, stock or property in New Mexico, it'll need to register there whichever state formed it, and we'll tell you so before you order.
